These Terms of Service ("Terms") govern your use of ACE '43 (the "App"), published by Zero Plus Plus Studios ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
ACE '43 is a single-player one-button arcade flying game for mobile devices. It is provided free of charge. It contains no advertising and no in-app purchases, requires no account, and does not need an internet connection to play.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial entertainment. You may not copy, modify, reverse-engineer, decompile, redistribute or sell the App or any part of it, except where such restriction is prohibited by applicable law.
The App, including its name, artwork, audio, code and design, is owned by Zero Plus Plus Studios and is protected by copyright and other intellectual-property laws. These Terms do not transfer any ownership to you.
Your progress and settings are stored only on your device. We do not back them up and cannot restore them. Uninstalling the App, clearing its data, or resetting your device will delete them permanently.
You agree not to use the App in any unlawful way, and not to attempt to interfere with, disrupt or gain unauthorised access to the App or any device or system it runs on.
We may update, change or discontinue the App, or any of its features, at any time and without notice. We may also update these Terms; the "Last updated" date above will change when we do, and continued use of the App after that constitutes acceptance of the revised Terms.
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or compatible with every device.
To the fullest extent permitted by applicable law, Zero Plus Plus Studios will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or game progress, arising out of or relating to your use of the App. Nothing in these Terms limits any liability that cannot be limited under applicable law, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
The App is distributed through Google Play. Your use of it is also subject to the terms of the store you obtained it from. Zero Plus Plus Studios, not the store, is solely responsible for the App.
